1. Introduction

1.2 Use of this site constitutes by the Purchaser acceptance of these Terms and Conditions.

1.3 Please read these Terms and Conditions carefully before downloading or purchasing a hunt or requesting a Personalised hunt, as you will be required to confirm that you agree with these Terms and Conditions when you submit your order.

1.4 Black Cat Treasure Hunts reserve the right to change these Terms and Conditions at any time.

1.5 If any of these Terms shall be determined to be unenforceable by reason of Law, then to the extent that a Term is held to be illegal or unenforceable, it shall be deemed to be severed, and remove from the relevant Clause so that all remaining Terms and Conditions shall remain in full force.

1.6 These Terms and Conditions should be governed by and construed in accordance with English Law.

1.7 The failure of Black Cat Treasure Hunts to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a formal waver.

2. Access to this site

2.1 Black Cat Treasure Hunts shall not be liable if this site is unavailable nor does Black Cat Treasure Hunts guarantee that the site will be free of viruses or other harmful components.

4.2 Black Cat Treasure Hunts entire liability to you in Contract, Tort, and negligence or otherwise in relation to orders placed on this site shall be limited to £500 for any one incident or series of related incidents.

4.3 Save as expressly set out in these Terms and Conditions any warranties or obligations implied by Statute or Common Law or Common Usage or by a course of dealing shall be excluded to the fullest extent permitted by Law.

4.4 It is hereby expressly agreed that any Purchaser of any hunt purchased from Black Cat Treasure Hunts shall be solely responsible for their safety and their property and any party undertaking the Trail. Black Cat Treasure Hunts cannot be held responsible for any loss or damaged property.

4.5 Nothing in these Terms and Conditions shall limit Black Cat Treasure Hunts liability for death or personal injury cause by negligence.

5. Use by the Purchaser of this site.

5.1 The Purchaser acknowledges by using this site that any copyrights, trade marks, patents or other proprietary rights and laws in favour of third parties are hereby recognised and acknowledged.

6. Proprietary Rights.

6.2 The Purchaser acknowledge that the Purchaser will not allow third parties who are not guests of the Purchaser to use the hunt which the Purchaser has purchased and that the hunt that has been purchased for the personal use of the Purchaser and their guests invited by the Purchaser to undertake the hunt and that the Purchaser will not resell or make publicly available the hunt for other parties to use without an expressed written consent of Black Cat Treasure Hunts.

7. Personal Trails

7.1 If a personal Trail is requested the Purchaser acknowledges that Black Cat Treasure Hunts shall retain any Intellectual Property Rights including copyright in the hunt produced.

7.2 It is hereby acknowledged by the Purchaser that they will keep indemnified and save harmless Black Cat Treasure Hunts in respect of any claim brought by any third party against Black Cat Treasure Hunts relating to any information provide to Black Cat Treasure Hunts to assist them in preparation of the Personalised hunt the Purchaser warrants that they are authorised and entitled to provide such information to Black Cat Treasure Hunts.

8 Refund and Cancellation Policy

8.1 Black Cat Treasure Hunts does not offer refunds for any hunts downloaded or Personal hunts provided to the Purchaser and once payment has been made cancellation is not possible.

9. Privacy Policy

9.1 Black Cat Treasure Hunts will adhere to the terms of the UK Data Protection Act 1998.

9.2 Black Cat Treasure Hunts will use the personal information which has been provided solely to administer activities on the site and for the purpose of marketing.

9.3 Whilst Black Cat Treasure Hunts will take every reasonable precaution to ensure that any credit card information is kept secure and strictly confidential and he Purchaser hereby acknowledges that they are aware that the transmission information via the Internet is not guaranteed as secure and therefore whilst every effort will be made to protect personal data including credit card information, this security cannot be guaranteed and the transmission of data is at the Purchasers risk.

This website is hosted by Modern Websites in the UK. The server is located just outside Vancouver, Canada and is managed by In2net.
Some of the data centre’s more notable security features are as follows:
    •    The facility is monitored by security cameras all around the building.
    •    Security guards will be on duty during after hours.
    •    All  server cabinets are secured in locked rooms and locked cabinets.
    •   All clients have their own access card and cabinet key to enter the server room and open only their own cabinet.
    •    This website server is mounted in a managed cabinet which only accessible by In2net staff.

    •    All traffic (transferral of files) between this website and your browser is encrypted and delivered over HTTPS.
